Privacy Statement

Note:  This English translation of our Privacy Statement is provided for your convenience.  Only the original German version of this text is legally binding.

Respecting your privacy is implicit for us.  This is also true for how we manage your personal data when you visit and use this website.  That is why we act in accordance with all applicable privacy and data protection laws.  In the following, you will learn how we handle your personal data, and in particular which data we collect, process and use, and for what purposes.

1 Scope of Applicability
1.1 This privacy statement is valid for the use of the webpages provided by Compex Systemhaus GmbH, which is reached under the web address www.compex-commerce.com (hereinafter the "Compex Commerce website").  This privacy statement is not applicable to other websites of Compex Systemhaus GmbH, or to the websites provided by others to which a link on the Compex Commerce website refers.

2 Personal Data
Personal data are individual items of personal or factual information about a specific or determinable natural person.  The basic item of personal data is your name.  Besides that, personal data can also be, for example, your gender, your date of birth, your address, your occupation, your e-mail address or your IP address, when these are associated with your name or can be associated with your name through means available to us.  Non-personal data, on the other hand, are such data with which the determination of your actual identity is either impossible, or would at least require considerable effort.  This includes the above items of information when we, for example,  receive them anonymously or under an alias name, and therefore cannot associate them with a real natural person.

3 Basic Principle of Anonymity
In using the Compex Commerce website, you remain anonymous to us as long as you do not voluntarily provide us with your personal data by subscribing to the Compex News or by writing to us using our contact form.

4 Providing personal data
4.1 You are neither required by law, nor by us, to provide any personal data in order to use the Compex Commerce website or for making a contract. You are not obliged to provide your personal data.
4.2 If you wish to receive Compex News or wish to contact us via the web form, you need to provide us with your personal data and allow us to collect them, as described in sections 6 and 7. If you do not wish to provide these data, you can neither receive Compex News, nor use the contact form.

5 Collection, Processing and Use of Personal Data
5.1 Each time you visit the Compex Commerce website, we automatically collect data on which IP address is assigned to your computing device, which browser and which operating system you use and which pages of the Compex Commerce website you visit.  These data are stored on our webserver only until you leave the Compex Commerce website.  There is no further storage of your data in log-files.
5.2 Beyond that, we collect, process or use your personal data only when you have freely made these available to us and this is legally permissible or you have agreed to it.  We use the personal data provided by you exclusively for the purposes explained in this Privacy Statement or for those purposes expressly agreed to with you.
5.3 We work with various service providers who help us provide, operate and maintain our IT systems, including the Compex Commerce website. This includes, for example, hardware and software providers, letter shops, Google Inc. (Google Analytics), hosting providers and data centers. When these companies provide services on our behalf, they may get access to your personal data. However, we have obliged them to protect your personal data as much as we do. Moreover, the legal prescriptions apply to our service providers accordingly.
5.4 A transfer, sale or other conveyance of your personal data to third parties does not occur, except when required for the described or agreed upon purposes, and either allowed without your permission by applicable privacy laws, or you have expressly agreed to it. This does not impair section 5.3., which stands independently from section 5.4.
5.5 Personal data provided by you on the Compex Commerce website, or collected by us while you visit our website, will not be used for any kind of automated decision-making.

6 Compex News
6.1 In order to send you the Compex News, we need your e-mail address.  We are pleased when you provide your name during the registration process, but this is not required;  you can also provide a pseudonym.  When you subscribe to the Compex News, your IP address, the name you provided, as well as the date and time are stored, in order to be able to provide evidence in the event that the e-mail address provided is misused. The legal basis for this is your given consent as well as our legitimate interests to protect us from malpractice and to send newsletters to our clients.
6.2 After your registration, you will receive a link from us by e-mail to confirm your registration.  Your subscription to the Compex News will first be activated when you have clicked the confirmation link in the e-mail message and we have received your confirmation (double opt-in process).  With this confirmation, you also declare that you are the owner of the e-mail address provided and that you wish to receive the Compex News from us via e-mail.  In the event that this confirmation does not occur within twenty-four hours, your registration will be automatically deleted from our database.
6.3 When you agree to provide us with your data, as described above, you have agreed to the following:  "Yes, I would like to register with Compex Systemhaus GmbH in order to receive the Compex News via e-mail, and agree to the Privacy Statement with regard to this.  I can cancel my registration at any time, and can revoke this permission with future effect at any time."
6.4 Without your permission, the e-mail address which you provide to receive the Compex News will not be used for any other purpose.  Any transfer to third parties will not occur, apart from cases when we are legally obliged to do so.
6.5 You can cancel delivery of the Compex News via e-mail at any time by using the "unsubscribe" link included in every e-mail edition.  You can also unsubscribe in writing (see section 11 below for contact details) or by e-mail to the address unsubscribe@compex-commerce.com.  Once you have unsubscribed, your e-mail address will be deleted from our e-mail newsletter distribution list.  The name and e-mail address you supplied will subsequently be stored only for so long and to the extent that we are legally required to retain them, or for as long as we need your data in order to perform any existing contractual obligation. 

7 Contact Form
7.1 When you contact us by using the contact form, you agree that your message and the contact data that you provided may be processed and used for the purposes of answering and making contact with you.  You can also provide a pseudonym as your name. The legal basis for this is your given consent as well as our legitimate interest to contact visitors of the Compex Commerce website electronically.   
7.2 In addition, you have given the following consent:  "Yes, the data that I have provided above and my message may be processed and used by Compex Systemhaus GmbH for the purposes of processing, contacting me and answering.  In this connection, I agree to the Privacy Statement.  I can revoke this consent at any time with future effect."
7.3 If we have received your contact data, provided by you in the contact form for the sole purpose of processing and answering your message, we will not use these data for any other ends. We do not pass on contact data to third parties, unless we are required to do so by law.
7.4 We will process and use the data provided in the contact form to process and answer your message. We delete these data 24 months after you have sent them, unless we are obliged to keep them longer for legal reasons, or for as long as we need your data in order to perform any existing contractual obligation. In such a case, we delete the respective data when the legally prescribed retention period has expired or when our contractual obligations have ended.
7.5 You can revoke your consent at any time (see section 14 below for contact details).  Your contact data will subsequently be stored only for so long and to the extent that we are legally required to retain them, or for as long as we need your data in order to perform any existing contractual obligation.

8 Revocation of Consent
8.1 Within the scope of legal provisions, you have at any time the possibility to revoke for the future your consent to the collection, processing and use of your personal data.  Please contact the address specified in section 14 below.
8.2 We explicitly point out that your revocation does not affect the processing of your personal data that we have undertaken upon your initial consent, and before your revocation.

9 Disclosure, Correction, Blocking and Deletion of Data
According to current privacy laws, we are required, upon request, to disclose which of your personal data we have processed, and to correct, block access to or delete the stored data about you. The correction, blocking or deletion of the data in such a case shall occur according to legal requirements.  Here also, please contact the address specified in section 14 below.

10 Right to complain
You have the legal right to complain to the regulating authority in matters of data protection. In our case, the “Landesbeauftragter für den Datenschutz und die Informationsfreiheit Baden-Württemberg” is responsible and can be reached online at the website https://www.baden-wuerttemberg.datenschutz.de/.

11 Use of Cookies
11.1 On the Compex Commerce website, we use so-called "cookies".  These are small text files stored on your end device (personal computer, smart phone, tablet etc.)  Most of the cookies used by us are deleted from your storage (hard drive, solid state disc, flash drive etc.) once your browser session has ended (so called "session cookies").  Other cookies remain on your computer and make it possible to recognize your computer upon your next visit (so called "persistent cookies").  We use cookies from third parties which enable them to collect, process or use personal data from you.

11.2 As soon as you visit the Compex Commerce website, you are being notified that this site uses cookies. If you accept this by clicking the „Got it“ button, the following cookies will be set:

11.3 In the security settings of your browser, you can at any time see or delete the stored cookies, or limit or prohibit the acceptance of cookies.

12 Use of Google Analytics
12.1 As described more detailed in section 12.2 and the following sections below, we use Google Analytics on the Compex Commerce website. Google Analytics is an online service provided by the US-based enterprise Google Inc. In order to analyze the data traffic on the Compex Commerce website, Google Analytics collects various data about you and your user behavior on the Compex Commerce website: This includes, for example, which web browser you use, where you come from, what are your language settings, which search engines you use, date and time of your visit of the Compex Commerce website, and how long you stay on which page. Your IP address will be collected in an anonymized way. See section 12.6 for details. Our purpose for using Google Analytics is to track and better understand the user behavior on the Compex Commerce website in order to optimize our website and create a experience for our users. The legal basis for the application of Google Analytics is our legitimate interest to use and optimize our Compex Commerce website for marketing purposes. User data collected by Google Analytics will be stored by Google for 26 months, and will be deleted afterwards.
12.2 The Compex Commerce website uses functions of the web analysis service Google Analytics.  These are provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so called "cookies".  These are text files that are stored on your computer and which make possible an analysis of the use by you of the Compex Commerce website.  The information gathered through the cookie about your use of the Compex Commerce website is generally transmitted to a server maintained by Google in the USA and stored there.
12.3 In the event of the activation of IP anonymization on the Compex Commerce website however, your IP address is abbreviated beforehand by Google within the member states of the European Union or the other contracting states of the European Economic Area.  Only in exceptional cases is the full IP address transmitted to a server maintained by Google in the USA and there abbreviated.  On behalf of the operator of the Compex Commerce website, Google will use this information to analyze your use of the Compex Commerce website, to produce reports on website activities and to provide further services to the website operator in connection with the use of the website or of the Internet.  The IP address transmitted by your browser within the scope of Google Analytics is not combined with other Google data.
12.4 You can prevent the storage of cookies through the appropriate setting of your browser software.  We must inform you however, that in this case you possibly may not be able to use all functions of the Compex Commerce website to their fullest.  In addition, you can prevent the collection by Google of the data generated by the cookie and related to your use of the Compex Commerce website (including your IP address), as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following address:  http://tools.google.com/dlpage/gaoptout?hl=en.
12.5 You can also prevent the collection by Google Analytics of data you generate on the Compex Commerce website and that is stored in the cookie, by activating the following link.  An "opt-out cookie" will be stored on your computer that will block the future collection of your data when visiting the Compex Commerce website (this does not, however, apply to other websites you visit or to other browsers used on the same computer): deactivate Google Analytics This alternative is particularly well suited for mobile devices.  If you decide to do this, don't delete the opt-out cookie.  Otherwise, you will lose the protection that this cookie provides, until you reinstall it.
12.6 Google Analytics was extended on the Compex Commerce website by the code "anonymizeIp".  The use of this code leads to the anonymous collection of your IP address through so called IP masking.  The last octet of your IP address is thereby set to zero.  For IPv6 addresses, these are the last 80 bits of the 128-bit address.  This occurs in working memory, before the data is written to persistent storage (see also https://support.google.com/analytics/answer/2763052).

13 IT Security
We take various technical and organizational security measures to protect the integrity and confidentiality of your personal data. During transmission, your personal data are encrypted by so-called the transport layer security technology, TLS (previously secure socket layer, SSL.) This means that the communication between your computer and Compex Commerce website servers is being conducted in accordance with a renounced encryption mechanism, which is generally regarded as secure in its latest version. At the moment, this is TLS version 1.2, 128 Bit. If your browser supports TLS, the transmission of your personal data will be protected by this feature. Most browsers will show you (in a dialog or graphical symbol) whether they support the relevant security protocol. Look into your browser’s help section for further information.

14 Right to Information and Questions on Data Protection
14.1 Upon request, we are happy to inform you whether and what personal data about you is stored by us.
